Terms of Service between Talon Communications Group, Inc. (dba TopekaOffice.com) and Office Owners
FREE REGISTRATION - Registering your available office space with TopekaOffice.com is absolutely free. There are also no joining or annual membership fees.
NEW CLIENT INTRODUCTIONS - Our effective introduction is made when we pass the details of an available office to an applicant. This introduction is confirmed by way of an email or fax confirmation.
NEW CLIENT REJECTION - It is assumed that the office owner acknowledges and accepts a new TopekaOffice.com applicant on receipt of our email introduction, unless the email is returned to TopekaOffice.com within forty-eight hours, stating when and which company had already introduced you to the particular applicant. This will avoid any misunderstanding.
NEW CLIENT CONFIRMATION - It is the responsibility of the office owner to provide TopekaOffice.com with the applicant's details (start date, rental and company name) when an applicant signs a lease.
PRIVACY POLICY - It is understood that any applicant that is introduced to you via TopekaOffice.com is strictly for your use only. The office owner can only use the user/applicant's information in relation to offering office space and related services. It cannot be passed on to a third party, such as another agent/broker or another office-space owner, without the prior approval of Talon Communications Group, Inc. / TopekaOffice.com and the applicant. The relationships between all parties must be agreed upon by TopekaOffice.com before the applicant details are passed on.
COMMISSION STRUCTURE - When an applicant that we have introduced to an office owner takes occupation or acquires the services of your available office space as a result of our introduction, it is the responsibility of the office owner to advise TopekaOffice.com in writing, at which time our introductory fees/commission become payable. Our introductory fees are 10% of the lease rate fee for a period up to one year. If the client signs an agreement for less than a year (eg six months) then our fees will be calculated on a pro rata basis. Should the lease rate increase or decrease during the term of the agreement, it is the responsibility of the office owner to advise TopekaOffice.com in writing, and our invoices will be adjusted accordingly.
PAYMENT - Settlement of invoices is to be made in advance, monthly, quarterly, six monthly or annually, depending on the circumstances and the terms agreed. Invoices will be issued when the office owner confirms to TopekaOffice.com the details of new client transactions.
CHANGE OF OWNERSHIP - In the event that an office space is sold; it is the responsibility of the office owner to advise TopekaOffice.com in writing and to ensure the new owners are aware of the future commission payment obligation to TopekaOffice.com. Should this not happen then the remaining commission payments will have to be paid by the original owners.
